REGISTRATION AND LOGIN/USER REPRESENTATIONS

Registration and/or login may be required, among other things, to access certain portions of our Site, to make certain Submissions and to obtain certain information or materials from Stonyfield such as special offers, coupons, and the like.

You may also opt to become a Registered User for purposes of facilitating your provision of certain information (including certain Personal Information (as that term is defined below) that may be required in order to enter promotions hosted and/or sponsored/co-sponsored by Stonyfield. Stonyfield may terminate your access to the Site (or portions thereof) if any of the information provided is found to be inaccurate, false, out of date or incomplete, or for violating these Terms of Use and/or the law, without prior notice or liability.

As part of the registration process, you are required to select and use a password. As a Registered User, you acknowledge that you are solely responsible for all activities that occur under your password or account while using the Site. You are responsible for maintaining the security and confidentiality of your password and monitoring and controlling access to your account. You agree to notify Stonyfield immediately of any unauthorized use of any account or password, or any other known or suspected breach of security.

If you are a Registered User, you may deactivate your account at any time by contacting us through our Contact Us page located at https://www.stonyfield.com/contact-us. Once your account is deactivated, it will not be viewable on the Site. As with any web site, even if a user deactivates his/her account, some information previously posted or otherwise uploaded may still be accessible by third parties. Stonyfield is not responsible for the continued accessibility of the information posted or uploaded by a Registered User prior to the deactivation of his/her account. You may re-activate your account by contacting us through our Contact Us page.

UNSOLICITED IDEAS POLICY

Stonyfield or any of its employees do not accept or consider unsolicited ideas, proposals or materials, including ideas and proposals for new or improved advertising campaigns or promotions, new or improved products, product enhancements, processes, packaging, marketing plans or new product names. Please do not submit through the Site any unsolicited ideas, original creative artwork, suggestions, proposals or other works in any form to Stonyfield or any of its employees. The sole purpose of this policy is to avoid potential misunderstandings or disputes when Stonyfield’s processes, products or marketing strategies, for example, might seem similar to ideas submitted to Stonyfield. USER SUBMISSIONS

Stonyfield does not claim ownership of any information or material a user transmits, posts or uploads to or through the Site by any means, including, without limitation, by message boards, chat rooms or similar discussion forums, blogs, wiki pages or otherwise (“Submissions”). All Submissions will be treated as non-confidential and non-proprietary, and may be disseminated or used by Stonyfield for any purpose and in any way without any compensation.

By making a Submission to or through the Site, you automatically grant Stonyfield an unrestricted, irrevocable, worldwide, royalty-free license to use, reproduce, display, publicly perform, transmit and distribute such Submission, alone or as part of other works in any form, media, or technology whether now known or hereafter developed.

Stonyfield does not represent or warrant the truthfulness, accuracy or reliability of any content, information or material contained in any Submissions made to or through the Site by users or endorse any statements, representations or opinions expressed by users in their Submissions. Your reliance on content, information, material, statements, representations or opinions contained in any Submissions made to or through the Site by other users shall be at your own risk. Any product claim, statistic, quote or other representation about a product and/or service contained in a Submission should be verified with the applicable manufacturer or provider.

Stonyfield is not responsible for screening or monitoring Submissions made to or through the Site by users. If notified by a user of any Submissions made to the Site allegedly in violation of these Terms of Use, Stonyfield may investigate the allegation and determine in good faith and its sole discretion whether to remove such Submission or any portion thereof. Stonyfield shall have no liability or responsibility to users for performance or nonperformance of such activities.

Stonyfield reserves the right not to post or to remove any information or material posted, uploaded, input or submitted to the Site for any reason, including, without limitation, any Submissions that, in its sole discretion, it deems to be in violation of these Terms of Use.

DIGITAL MILLENNIUM COPYRIGHT ACT

If you are a copyright owner or authorized to act on behalf of one and believe that a user Submission infringes upon your copyrights, you may submit a copyright infringement notification pursuant to the Digital Millennium Copyright Act (“DMCA”) to Stonyfield’s DMCA designated agent. The DMCA specifies that all such notifications be in writing and must include the following information:

Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material;
Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an electronic mail address at which you may be contacted;

A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;

If you do not comply with all of the DMCA requirements as described above, your DMCA copyright infringement notice may not be valid.

If you believe that your removed Submission is not infringing, or that you have the authorization from the copyright owner, the copyright owner’s agent, or pursuant to the law, to post and use the material in your Submissions, you may send a counter-notice containing the following information to the Stonyfield DMCA agent:

Identification of the Submissions that have been removed and the location at which the Submissions appeared before it was removed;
A statement that you have a good faith belief that the Submissions were removed as a result of mistake or a misidentification of the Submissions; and
Your name, address, telephone number, e-mail address, a statement that you consent to the jurisdiction of the Federal courts in the State of New Hampshire, and a statement that you will accept service of process from the person who provided notification of the alleged infringement or an agent of such person. If a counter-notice is received by the Stonyfield DMCA designated agent, Stonyfield may send a copy of the counter-notice to the original complaining party informing that person that Stonyfield may replace the removed Submission in ten (10) business days. Unless the original complaining party files an action seeking a court order against the Submission’s provider, the removed Submission may be replaced in ten (10) to fourteen (14) business days after receipt of the counter-notice.

Only DMCA infringement notifications and counter-notices should be sent to our DMCA designated agent.
