Jack Johnson Concert Ticket Sweepstakes
**** OFFICIAL SWEEPSTAKES RULES **** NO PURCHASE OR PAYMENT OF ANY KIND NECESSARY VOID WHERE PROHIBITED BY LAW
Eligibility. Open to legal residents of the United States who are 18 years of age or older at the time of entry (or in the case of legal residents of jurisdictions where the age of majority is greater than 18 years of age, such age of majority under the laws of the jurisdiction in which they reside at the time of entry). Employees, officers, directors, agents, representatives and independent contractors (and their immediate family members and members of the same households (whether related or not)) of the Sponsor or their respective parent, subsidiaries and affiliated companies are not eligible to participate. Employees, officers, directors, agents, representatives and independent contractors (and their immediate family members and members of the same households (whether related or not)) of Brushfire Records or their respective parent, subsidiaries and affiliated companies are also not eligible to participate. Subject to all federal, state and local laws and regulations. Void in Puerto Rico, and all other U.S. territories and possessions outside of the continental United States and where prohibited by law or restricted by such laws, including but not limited to jurisdictions with laws that would require registration and/or trust account or posting of a bond, or any other requirements that are not satisfied by these Sweepstakes Rules. Application of Rules. By submitting an entry, Sweepstakes contestants agree to be bound by these Official Sweepstakes Rules. Contestants further agree that the Sponsor shall retain full authority, in their sole discretion, to interpret and administer these rules, and to be bound by all decisions and interpretations made in good faith by the Sponsor. Entry. The Sweepstakes begins at 12:01 a.m. Eastern Standard Time (EST) on April 1, 2008 and ends at 11:59 p.m. (EST) on June 14, 2008 (the “Sweepstakes Period”). No purchase is necessary to enter. Visit www.stonyfield.com and complete the Sweepstakes entry form, include your first name, last name, address (including zip code), email address, daytime telephone number (including area code), gender and age. All online entries must be received no later than 11:59 p.m. EST on June 14, 2008. If there is a dispute over the identity of an online contestant, entry will be deemed submitted by the Authorized Account Holder regardless of the individual that submitted the entry. “Authorized Account Holder” is defined as the natural person who is assigned an e-mail address by an Internet access provider, online service provider or other organization (e.g. business, educational, institution, etc.) responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. No more than one entry per email address per day during the Sweepstakes Period is allowed. Proof of sending will not be deemed to be proof of receipt by the Sponsor. Entries become the property of the Sponsor. Information Contained in Entry. By submitting an entry, each Sweepstakes contestant warrants and represents to the Sponsor that the information contained in the entry is true and correct in all material respects and that the Sponsor may rely on such information in their efforts to comply with applicable laws and regulations. Grand Prize. The Sponsor will award one (1) grand prize. Winner will receive two tickets to one of Jack Johnson’s August, 2008 concerts, round trip, coach class airfare for two to the concert city location, and hotel accommodations for two nights for two (Approximate value $1,500.00.) Concert location will be determined by Sponsor, based on proximity to winner’s respective residence. If a winner is unable to attend the Concert on the scheduled date, the prize will be forfeited and awarded to an alternate winner. The prize includes roundtrip coach airfares between the major commercial airport closest to the winners’ respective residence and the Concert city location and hotel accommodations for two nights for two. Actual value of prize may vary based on winners’ point of departure, airfare fluctuations and dates of travel. On behalf of the Sponsor, Brushfire Records will be responsible for arranging flight and lodging reservations (in connection with which each winner will be consulted); Brushfire Records on behalf of the Sponsor, however, retains the right to exercise discretion and their discretion will be final. If winner resides within 100 miles radius of the Concert site, ground transportation or reasonable travel stipend may be provided in lieu of air transportation and no compensation or substitution will be provided for difference in prize value. Specifics relating to prize and alternate prize are at sole discretion of the Sponsor. Winners are solely responsible for any costs and expenses due in connection with the prizes not specified herein, including without limitation, all applicable federal, state and local taxes, telephone calls, gratuities, ground transportation, souvenirs, and any costs and expenses not described herein as being awarded. Prizes may not be transferred or assigned. No cash value or substitution of any prize will be permitted or provided, except that the Sponsor, in their sole discretion, may provide a prize of comparable or greater value. First Prize. The Sponsor will award ten (10) first prizes. Winners will receive a guitar to be selected by Brushfire Records on behalf of the Sponsor at their sole discretion, and autographed by Jack Johnson (Approximate value $500.00.) Prizes will be shipped directly to the winners by Brushfire Records. The Sponsor is not responsible for prizes that are lost, misdelivered or damaged by the postal service or carrier. Specifics relating to prizes and alternate prizes are at sole discretion of the Sponsor. Winners are solely responsible for any costs and expenses due in connection with the prizes not specified herein, including without limitation, all applicable federal, state and local taxes, telephone calls, and any costs and expenses not described herein as being awarded. The Sponsor will award fifty (50) second prizes. Winners will receive an autographed copy of Jack Johnson’s new CD “Sleep through the Static,” (Value $50.00.) to be shipped directly to the winners. Prizes may not be transferred or assigned. No cash value or substitution of the prize will be permitted or provided. Prizes Restrictions. The Sponsor reserves the right to require winners to show proof of identity prior to receiving prizes. Winners must execute an Affidavit of Eligibility and Release. Upon receipt of the Affidavit of Eligibility and Release by the Sponsor the winner must execute and return this document via the provided overnight shipping supplies within ten (10) business days of receipt. If these documents are returned as undeliverable or are not completed and returned by such deadline or if a potential winner does not meet the eligibility or other requirements of the Sweepstakes, the prize will be forfeited and an alternate winner may be selected. The Sponsor is not responsible for prize information or documents that are lost or misdelivered by the postal service or carrier. Release. By acceptance of any prize, winner agrees to release, hold harmless and indemnify the Sponsor, Brushfire Records, and Jack Johnson and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, assignees, licensees, attorneys, representatives and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of any prize awarded herein, including my acceptance of any prize and participation in the subject Course. Announcement of Winners. The Sponsor will post the name and address of the winners at www.stonyfield.com following the completion of the Sweepstakes and verification and qualification of all winners on or around June 30, 2008. Use of Winners’ Names and Likeness. By submitting an entry, you acknowledge and agree that, if you are selected as a winner, we will post your name and address at www.stonyfield.com. Each winner who accepts any prize will be deemed thereby to have granted to us the right, at any time and from time to time, to print, publish, broadcast and use, worldwide and in any media now known or hereafter developed, including but not limited to, the Internet and world wide web, the winner’s name, portrait, picture, voice, likeness and biographical information as news or information and for advertising and promotional purposes without additional consideration, except where prohibited by law. Unlawful Conduct and Disqualification. The Sponsor reserves the right, in their sole discretion, to disqualify any Sweepstakes contestant who the Sponsor determines, in their sole discretion, is (a) tampering with the entry process or the operation of the Sweepstakes or of any web site owned, operated or controlled by the Sponsor or their parents, subsidiaries or affiliated companies; (b) ineligible to participate in the Sweepstakes; (c) submitting more than the allowed number of entries per day; or (d) behaving in a non-sportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person. Use of any robotic, automatic, programmed or like entry methods is expressly prohibited and all such entries shall be ineligible for prizes. Any attempt by a contestant to deliberately damage any web site or undermine the legitimate operations of the Sweepstakes is a violation of criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek damages from any such contestant to the fullest extent permitted by law and to disqualify such contestant from the Sweepstakes. Limitation of Liability and Remedies. WE SHALL HAVE NO LIABILITY WITH RESPECT TO ANY ENTRIES THAT ARE INCOMPLETE, LATE, GARBLED, MUTILATED, ILLEGIBLE, DELAYED, MISDELIVERED, LOST, DAMAGED, STOLEN, DELETED OR LOST DURING TRANSMISSION, MISDIRECTED OR OTHERWISE NOT TIMELY OR ACCURATELY DELIVERED OR DIFFICULT TO INTERPRET OR UNDERSTAND. ENTRIES RECEIVED BY US THAT ARE INCOMPLETE, LATE, GARBLED, MUTILATED, ILLEGIBLE, DELAYED, MISDELIVERED, LOST, DAMAGED, STOLEN, DELETED OR LOST DURING TRANSMISSION, MISDIRECTED OR OTHERWISE DIFFICULT TO INTERPRET OR UNDERSTAND SHALL NOT BE ELIGIBLE FOR PRIZES AND WE WILL NOT DELIVER ANY NOTICE OF SUCH INELIGIBILITY TO THE PARTICIPANT. WE SHALL HAVE NO LIABILITY FOR FAULTY, INCORRECT OR MISTRANSCRIBED TRANSMISSIONS, TECHNICAL HARDWARE OR SOFTWARE FAILURES OF ANY KIND, INTERRUPTED OR UNAVAILABLE NETWORK SERVER OR OTHER CONNECTION, MISCOMMUNICATIONS, FAILED TELEPHONE OR COMPUTER OR TELEPHONE TRANSMISSIONS OR TECHNICAL FAILURE, JUMBLED, SCRAMBLED OR MISDIRECTED TRANSMISSIONS OR OTHER ERROR OF ANY KIND WHETHER HUMAN, MECHANICAL OR ELECTRONIC. UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL THE RELEASED PARTIES BE LIABLE FOR ANY DIRECT, INCIDENTAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES, OR EXEMPLARY OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONJUNCTION OR CONNECTION WITH CONTESTANTS’ PARTICIPATION IN THE SWEEPSTAKES, POSTING ON OR ACCESS AND/OR DOWNLOAD OF ANY MATERIALS OR INFORMATION FROM ANY WEB SITE OWNED, OPERATED OR CONTROLLED BY THE SPONSOR OR THEIR PARENT, SUBSIDIARIES OF AFFILIATED COMPANIES, AND/OR ANY PRIZE (INCLUDING, BUT NOT LIMITED TO, ITS ACCEPTANCE OR USAGE) AWARDED TO CONTESTANTS IN CONNECTION WITH THE SWEEPSTAKES, INCLUDING WITHOUT LIMITATION DAMAGE TO PROPERTY AND, TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAMAGES FOR BODILY OR PERSONAL INJURY, INCLUDING DEATH, EVEN IF THE RELEASED PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR LOSS. CONTESTANTS AGREE THAT THE AGGREGATE LIABILITY, IF ANY, OF THE RELEASED PARTIES ARISING OUT OF ANY KIND OF CLAIM (WHETHER IN CONTRACT, TORT, OR OTHERWISE) SHALL NOT EXCEED $1.00. Indemnification. Each Sweepstakes contestant agrees to indemnify and hold harmless the Released Parties from and against any loss, damage or expense (including court costs and attorneys’ fees) that the Sponsor, and/or their parent, subsidiaries or affiliated companies, their successors or assigns, may suffer or incur as a result or in conjunction or connection with the prizes awarded to contestant (including, without limitation, the receipt and/or use of said prizes). Amendments. We reserve the right to suspend, cancel, terminate or modify the Sweepstakes without advance notice in the event we believe, in our sole discretion, that any computer virus, worms, bugs, tampering, spamming, unauthorized intervention, fraud, technical failures or other errors or problem beyond our control could corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, and thereafter to re-commence such Sweepstakes, if at all, only at such time(s) and upon such terms and conditions as we shall deem reasonable under the circumstances. Severability. If any one or more provisions of these Official Sweepstakes Rules are held to be invalid, illegal or unenforceable by a court of competent jurisdiction, such invalidity, illegality or unenforceability shall not affect the validity, effect or enforcement of any other provision or provisions of these Official Sweepstakes Rules. Winners List. For a copy of the rules send a self-addressed stamped envelope to above address marked Jack Johnson Sweepstakes, Attn: Rules. Governing Law; Jurisdiction; Venue. These Official Sweepstakes Rules are governed by and shall be construed by the laws of the State of New Hampshire, without application of its choice of law principles. Any dispute that may arise hereunder, if not settled by the parties directly or through alternate dispute resolution, shall be brought solely in the appropriate state or federal court sitting in New Hampshire, and contestant consents to the personal jurisdiction and venue thereof. Force Majeure. The failure of the Sponsor to comply with any provision of this Official Sweepstakes Rules due to an act of God, hurricane, war, terrorism, fire, riot, earthquake, actions of governmental authorities outside the control of the Sponsor or other force majeure event shall not be considered a breach of these Official Sweepstakes Rules.
